1. Acceptance of Terms

SinewFit LLC ("SinewFit," "we," "us," "our"), a New Jersey Limited Liability Company, operates the website sinewfit.ai and the SinewFit application (collectively, "the Service"). By accessing or using the Service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of any updates or modifications to these Terms.

2. Description of Service

SinewFit is a web-based fitness application that provides AI-generated workout plans, exercise recommendations, and workout logging tools. The Service uses artificial intelligence to create personalized fitness programs based on user-provided information such as fitness goals, experience level, available equipment, and physical metrics.

The Service is intended for informational and educational purposes only. SinewFit does not provide medical advice, diagnosis, or treatment of any kind.

4. Assumption of Risk

You acknowledge that physical exercise and fitness activities involve inherent risks, including but not limited to: physical injury, muscle strains, sprains, fractures, joint damage, cardiovascular events, disability, and in extreme cases, death. These risks may result from your own actions, the actions of others, equipment malfunction, or the conditions of the exercise environment.

By using the Service, you voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of SinewFit or its creators, and you agree to accept full responsibility for any injury, illness, damage, loss, or cost resulting from your participation in any exercise or fitness program recommended by the Service.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SinewFit, its creators, operators, affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of, or inability to use, the Service.

This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not SinewFit has been advised of the possibility of such damages. This includes, without limitation, damages for personal injury, pain and suffering, emotional distress, loss of revenue or profits, loss of data, or any other damages.

In no event shall the total aggregate liability of SinewFit exceed the amounts paid by you, if any, for accessing the Service during the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless SinewFit and its creators, operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any injury or harm you sustain as a result of following workout plans, exercise recommendations, or other content provided by the Service.

7. User Accounts and Security

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You must immediately notify SinewFit of any unauthorized use of your account or any other breach of security. SinewFit shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.

8. Acceptable Use

You agree not to:

• Share your account credentials with any other person or allow others to access your account
• Create multiple accounts for the same individual
• Scrape, crawl, or use automated means to access or extract data from the Service
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Use the Service to develop a competing product or service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any systems or networks connected to the Service
• Use the Service for any unlawful or fraudulent purpose

9. AI-Generated Content

The workout plans, exercise recommendations, and other fitness content provided by the Service are generated algorithmically using artificial intelligence. While we strive for accuracy and safety, AI-generated content may contain errors, inaccuracies, or recommendations that may not be appropriate for your specific circumstances.

You should always use your own judgment when following AI-generated workout plans. If an exercise feels unsafe, causes pain, or seems inappropriate for your fitness level, you should skip it or substitute an alternative. The Service is a tool to assist your fitness journey, not a replacement for professional guidance from certified personal trainers or medical professionals.

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and the AI algorithms used to generate workout plans, are the exclusive property of SinewFit LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any personal data and information you provide to the Service. By using the Service, you grant SinewFit a limited license to use your data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

11. Termination

SinewFit reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, abusive behavior, or extended periods of inactivity.

You may terminate your account at any time by contacting us at the email address listed below. Upon termination, your right to use the Service will immediately cease, and you may request deletion of your data in accordance with our Privacy Policy.

12. Modifications to Terms

SinewFit reserves the right to modify these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. 13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. SinewFit LLC is registered in the State of New Jersey. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of New Jersey, and you hereby consent to the personal jurisdiction and venue of such courts.
